Independent Distributor Terms

1. Independent marketplace participants
Distributors use Perth Leaflet Distribution as independent marketplace participants.
Unless separately agreed in writing, accepting jobs through the marketplace does not make a Distributor an employee of Perth Leaflet Distribution.
A Distributor decides whether to apply for or accept available work.
2. Distributor responsibilities
A Distributor who accepts a job must:
- provide accurate information about their capabilities;
- follow the agreed campaign instructions;
- distribute material within the agreed area;
- respect applicable restrictions on advertising material;
- avoid trespassing;
- act safely;
- avoid littering;
- not intentionally discard undistributed material;
- provide agreed proof of completion; and
- promptly report significant problems affecting the job.
3. Transport and equipment
Unless expressly stated otherwise in a particular engagement, Distributors are responsible for arranging the ordinary transport, clothing, mobile device and other equipment they choose to use to perform an accepted job.
4. Safety
Distributors are responsible for assessing whether conditions are safe.
They should not enter unsafe properties or place themselves at unreasonable risk because of aggressive animals, severe weather, traffic, inaccessible premises or another hazard.
Safety takes priority over completing a particular address.
5. Distribution restrictions
Distributors must respect applicable signs, directions and legal restrictions concerning unsolicited advertising material.
Material must be placed securely and appropriately rather than left on footpaths, roads or other locations where it may become litter.
6. Proof of completion
A campaign may require reasonable evidence such as:
- GPS records;
- route information;
- photographs;
- timestamps;
- completion reports; or
- another agreed verification method.
Evidence must be genuine.
Falsifying delivery evidence may result in non-payment, removal from the marketplace and other action permitted by law.
7. Payment
The amount offered for a job will be displayed or agreed before acceptance.
Payment may be subject to confirmation of completion and the marketplace payment process disclosed for the engagement.
8. Taxes and business obligations
Independent Distributors are responsible for determining and meeting their own tax, GST, insurance, registration and other legal obligations applicable to their activities.
9. No guaranteed work
Creating an account does not guarantee that jobs will be available or offered.
10. No employment representation
Nothing in these Terms is intended to incorrectly characterise a relationship that, as a matter of law, is an employment relationship. The legal nature of any arrangement depends on its actual circumstances and applicable law.
